TERMS AND CONDITIONS OF SERVICE

By engaging the services of Lime Light Photography (Pty) Ltd (trading as Lime Light Productions, hereinafter referred to as “the Photographer” or “the Company”), the Client agrees to be bound by the following Terms and Conditions.
1. SCOPE OF SERVICES
These Terms and Conditions apply to all photography, videography, live-streaming, editing, and production services provided by Lime Light Productions across all service categories, including Weddings, Corporate Events, Funerals, and Private Events. Specific terms applying strictly to wedding assignments are outlined in Section 5.
2. BOOKING AND PAYMENT TERMS
Booking Deposit: A 50% non-refundable deposit is required to secure any booking and reserve the agreed-upon date(s).
Final Payment: The remaining balance of the total invoice is strictly due on the day of the event/wedding prior to or upon completion of shooting.
Production & Delivery Hold: Production and delivery of finished physical products (such as Albums), edited digital images, raw files, and final video edits will not commence until the full invoice amount has been received in cleared funds.
Non-Refundable Deposit: In the event of cancellation by the Client for whatever reason, the 50% deposit/booking fee is non-refundable and shall be retained by the Company as liquidated damages.
3. COPYRIGHT LAW & USAGE RIGHTS
Ownership: The copyright of all images, audio, and video recordings taken by the Photographer remains the sole property of Lime Light Photography (Pty) Ltd.
Client Usage: The Photographer grants the Client a personal, non-exclusive license to make copies of the images/videos under the condition that they are for personal use by the Client, their friends, and relatives.
Commercial Restrictions: Sale, publication, broadcasting, or any commercial use of the photographs or videos is strictly prohibited without prior written permission from the Photographer.
Corporate Usage (Where Applicable): For corporate clients, commercial usage rights are limited to the specific marketing, promotional, or internal scope outlined in the agreed written service quote or invoice.
4. MODEL RELEASE & PROMOTIONAL USE
The Client grants the Photographer, its legal representatives, heirs, and assigns, the irrevocable and unlimited right and consent to:
Use the photographs, video footage, and audio recordings of the Client(s) for editorial, competition, advertising, website display, portfolio, and social media promotion.
Alter or edit the photographs without restriction.
Copyright the resulting images.
The Client hereby releases the Photographer and its legal representatives, heirs, and assigns from all liability and claims in connection with the use of the images.
5. SPECIFIC WEDDING & EVENT CONDITIONS
5.1 Pre-Wedding Consultation
A pre-wedding consultation normally happens at the time of booking. The Client will outline broadly what is required, and the Photographer will advise on planning, logistics, and timings where needed.
5.2 Conditions of Service & Meals
Vendor Meals: The Client agrees to provide a hot meal (with designated seating) for the Photographer(s) during events lasting longer than five (5) hours.
Guest Treatment: The Photographers are expected to be treated as guests of the wedding/event and will break for meals at the same time as the guests to ensure coverage is not missed during key moments.
5.3 Cooperation & Helper
The Client and the Photographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract.
Designated Helper: It is recommended that the Photographer be provided with a helper (usually the Best Man or an event coordinator) who will point out key individuals to be photographed and assist in organizing family/group shots.
Event Notifications: The Client agrees to give the Photographer sufficient warning of key events (e.g., bouquet throwing, cake cutting, speeches) to allow adequate setup time.
Guest Discretion: Not all guests like having their photos taken. In such cases, the Photographer will use their discretion but cannot be held responsible for a lack of photos of these individuals.
5.4 Schedule, Lateneess & Hard Cut-Off Time
Standard Arrival: The Photographer’s schedule begins with arrival 2 hours prior to the ceremony (unless otherwise agreed in writing).
Punctuality: Punctuality and cheerful cooperation are essential to producing outstanding results. Where an event does not run on time (e.g., extreme lateness of arrival), the Photographer cannot guarantee to deliver the normal full set of photos, though reasonable efforts will be made to compensate.
10:00 PM Hard Cut-Off: Under no circumstances are any of our photographers permitted to stay after 10:00 PM due to security and safety reasons.
5.5 Paparazzi Wedding Guests & Interference
All guests naturally want to take photos/videos. In the spirit of cooperation, the Client agrees to give the Photographer precedence over guests to capture required coverage. The Photographer cannot be held liable for missed or compromised photos/videos if guests continually interrupt the Photographer’s work or block line-of-sight.
5.6 House Rules & Venue Restrictions
Photographers are subject to rules imposed by venue management, registrars, or officiating ministers (e.g., restrictions on flash photography or designated shooting locations). The Client agrees to accept the technical limitations imposed by these third-party rules. The Client is advised to verify venue rules in advance.
5.7 Special Photography (Light Painting)
Under no circumstances will Light Painting photography or special outdoor effects be executed in the event of wind, rain, or adverse weather conditions due to equipment and safety risks.
6. LIMIT OF LIABILITY
Illness or Injury: If a Photographer becomes ill or injured and cannot perform the specified services, the Photographer will attempt to procure a replacement photographer. If a second photographer was already scheduled for the day, that photographer will shoot the event independently. If no replacement can be sourced, liability is strictly limited to a full refund of payments received.
Loss or Damage of Media: The Photographer maintains strict operational backups and safeguards to prevent data loss. However, in the unlikely event that images/footage are lost, stolen, or destroyed beyond or within the Company’s control, liability is strictly limited to the return of fees paid (excluding the initial booking deposit) relative to the proportion of unsupplied media.
Force Majeure & Technical Failure: The Photographer shall not be liable for failure to perform duties due to acts of God, extreme weather, road closures, power outages/load shedding affecting venue equipment, or third-party streaming platform downtime during live streams.
7. ACCEPTANCE OF TERMS
Payment of the booking deposit or signature on a service quote constitutes full understanding and acceptance of all terms, conditions, and limitations outlined in this contract.
